Falcon Labs – Ad Unit Privacy Policy

This Privacy Policy explains how Falcon Digital Labs LLC (“Falcon,” “we,” “our,” or “us”) collects and uses personal data when you interact with advertisements and offers displayed through the Falcon ad unit (the “Ad Unit”). This Policy is specific to the Ad Unit and is intended to provide transparency about our practices in compliance with applicable data protection laws, including the EU General Data Protection Regulation (GDPR), the UK GDPR, the Swiss Data Protection Act, and U.S. state privacy laws such as the California Consumer Privacy Act (CCPA/CPRA).
1. Information We Collect
When you interact with the Ad Unit, we may process:
- Publisher-provided identifiers: e.g., first name, email address, or other details the website or app provides to us.
- Interaction data: e.g., whether you viewed, clicked, or dismissed an offer.
- Technical data: e.g., IP address, device/browser type, and activity logs needed to display and secure the Ad Unit.
What we do not collect:
- We do not track your browsing history after you leave the Ad Unit.
- We do not collect or monitor your activities on an advertiser’s site, beyond receiving confirmation that a qualifying event (e.g., a completed purchase or subscription) occurred, solely for the purposes of attribution, conversion measurement, and billing.
- We do not sell personal data.
Email Use for User-Initiated Requests
When you choose to engage with certain offers in the Ad Unit, the publisher may provide Falcon with your email address solely for the purpose of fulfilling your request. For example, if you click a call-to-action (“CTA”) to receive more information about an advertiser’s offer, Falcon may send you a one-time email containing the details you requested.
By interacting with a call-to-action in the Ad Unit (such as requesting more information about an offer), you authorize Falcon to process the information necessary to fulfill that interaction, including sending you the requested one-time email.
We process this email address only to:
- Fulfill your specific request (e.g., sending you information about an offer you clicked).
- Confirm your interaction with the Ad Unit.
- Maintain records for security, fraud prevention, and compliance.
We do not share your email address with the advertiser.
You will receive only one email related to your specific request unless you separately opt in to additional communications. You may unsubscribe from receiving similar future emails at any time, and we will maintain a suppression record to honor your preferences.
No Marketing Without Opt-In. We do not use email addresses collected through the Ad Unit for marketing, promotional campaigns, or ongoing communications unless you separately and explicitly provide opt-in consent. Email addresses provided for a one-time request will never be used for any additional purposes without your clear and affirmative permission.
Unsubscribe and Email Preferences. If you receive an email from Falcon related to an offer you interacted with in the Ad Unit, you may unsubscribe from receiving similar future emails at any time by clicking the unsubscribe link included in the message. Once you unsubscribe, Falcon will maintain a hashed suppression record to ensure that you do not receive additional emails from us unless you later request them or provide new opt-in consent. We do not use email addresses collected through the Ad Unit for ongoing marketing or promotional purposes unless you provide explicit opt-in consent.
2. How We Use the Information
We use this data only to:
- Display and personalize the Ad Unit (for example, greeting you by first name, if provided by the publisher).
- Direct you to the advertiser’s website when you choose to engage with an offer.
- Ensure security, prevent fraud, and measure performance of the Ad Unit.
- Comply with applicable laws and regulations.
- Send a one-time email that you explicitly requested when engaging with an offer in the Ad Unit (your email address remains confidential and is not shared with the advertiser).
We do not use Ad Unit personal data for cross-site behavioral profiling or unrelated marketing. Falcon does not combine personal information collected through the Ad Unit with data collected from other services or third-party sources.
3. Your Choices and Consequences
- You are under no obligation to click on or engage with offers in the Ad Unit.
- You can continue using the publisher’s site or app whether or not you engage with offers.
- If you choose to engage, we may transmit limited data (e.g., your first name if necessary to pre-populate a form).
4. Relationship with Publishers and Advertisers
- Publishers: The site or app where you see the Ad Unit may share limited data with Falcon. Publishers remain responsible for their own data collection and disclosures.
- Falcon: We process publisher-provided data as a service provider/processor, and we process Falcon Data (aggregated logs, fraud detection, metrics) as an independent controller.
- Advertisers: Once you click through to an advertiser’s site, their privacy policy governs. Falcon does not collect personal data on advertiser websites.
5. Cookies and Tracking Technologies
The Ad Unit may use cookies, pixels, SDKs, or device identifiers to:
- Measure engagement (impressions, clicks, dismissals).
- Prevent fraud and ensure proper delivery of ads.
We do not use these technologies for behavioral advertising across third-party sites. You can manage cookies via your browser or operating system settings. Falcon does not permit third parties to place cookies through the Ad Unit for their own advertising or analytics purposes.
6. Legal Bases for Processing (GDPR/UK GDPR)
Under Article 6 GDPR, we rely on the following legal bases for processing:
- Consent (Art. 6(1)(a)): When you click or engage with an offer.
- Legitimate interests (Art. 6(1)(f)): Operating and securing the Ad Unit, measuring performance, preventing fraud.
- Legal obligation (Art. 6(1)(c)): Where required to comply with laws or respond to authorities.
7. Data Sharing
We may share data as follows:
- With Advertisers: Only when strictly necessary to complete your chosen interaction (e.g., pre-populating your first name in a form).
- With Service Providers: Trusted vendors supporting hosting, analytics, or fraud detection.
- For Legal Reasons: If required by law, regulation, or to protect our rights.
We do not “sell” or “share” personal data as defined by the CCPA/CPRA.
8. International Data Transfers
If your data is transferred outside your home country, Falcon uses lawful transfer mechanisms:
- EU Standard Contractual Clauses (Arts. 46–47 GDPR).
- UK Addendum to the SCCs.
- Swiss Addendum where applicable.
We also apply technical and organizational safeguards (encryption, minimization, role-based access).
9. Data Retention
We retain personal information for no longer than is reasonably necessary for the purposes disclosed in this Privacy Policy.
- Interaction logs: retained 30–90 days for fraud prevention and reporting.
- Aggregated/de-identified data: retained longer for analytics and product improvement.
- Legal records: retained as required by law.
- Email addresses used for user-initiated requests are retained only for the limited period necessary to fulfill your specific request and to maintain a suppression record. The suppression record is stored in hashed form solely to ensure that we do not send future emails to users who have unsubscribed or exercised their opt-out rights. We do not retain email addresses collected through the Ad Unit for long-term storage or for unrelated purposes.
Personal data is securely deleted or anonymized when no longer needed (consistent with Art. 5(1)(e) GDPR).
10. Children’s Privacy
The Ad Unit is not directed at children under 16. We do not knowingly process children’s personal data for ad personalization (Art. 8 GDPR). If we learn we have inadvertently collected data from a child, we will delete it.
11. EU/UK/Swiss Privacy Rights (GDPR)
Under Articles 15–22 GDPR (and equivalent rights under UK and Swiss law), you may have rights including:
- Access, correction, deletion, and portability of your data.
- Restriction of processing.
- Objection to processing (including personalization).
- Withdrawal of consent at any time (without affecting prior lawful processing).
You also have the right to lodge a complaint with a supervisory authority (Art. 77 GDPR).

12. U.S. State Privacy Rights (CCPA/CPRA and others)
If you are a California resident (or a resident of states with similar laws):
- Falcon does not sell or share your personal data.
- You may request access to and deletion or correction of your personal data.
- You may designate an authorized agent to submit requests.
Requests may be submitted to privacy@falconlabs.us.
Right to Opt Out of Direct Marketing Communications. Falcon does not use personal information collected through the Ad Unit, including email addresses, for direct marketing. However, if you receive a user-initiated email related to an offer, you may opt out of receiving similar future communications by using the unsubscribe mechanism included in the email.
Right to Appeal. If we deny your privacy rights request, you may appeal our decision by contacting us at privacy@falconlabs.us. We will review and respond to all appeals as required under applicable state privacy laws.
No Sale or Sharing of Personal Information. Falcon does not “sell” or “share” personal information as these terms are defined under the CCPA/CPRA. For example, if you provide your email address through the Ad Unit to receive additional information about an offer, Falcon will use it solely to fulfill your request and will not disclose it to advertisers or third parties for cross-context behavioral advertising, targeted advertising, or any commercial purpose.
Sensitive Personal Information. Falcon does not collect or use “sensitive personal information” (as defined under the CCPA/CPRA) in connection with the Ad Unit. As such, the right to limit our use or disclosure of sensitive personal information does not apply.
Automated Decision-Making. Falcon does not use personal information collected through the Ad Unit to make automated decisions that produce legal or similarly significant effects on you (such as eligibility decisions, credit decisions, or profiling for behavioral advertising).
13. Security Measures
We protect data through measures consistent with Article 32 GDPR, including:
- Encryption in transit and at rest.
- Role-based access and authentication controls.
- Security monitoring and vulnerability testing.
- Documented incident response procedures.
14. Subprocessors
We use carefully selected subprocessors (e.g., cloud hosting, fraud detection). An up-to-date list is available upon request at privacy@falconlabs.us.
15. International Representation
Falcon is in the process of appointing an EU representative (Article 27 GDPR) and a UK representative. In the interim, individuals located in the EU or UK may direct all privacy-related inquiries to privacy@falconlabs.us.
16. Updates
We may update this Ad Unit Privacy Policy periodically. Updates will be effective upon posting within the Ad Unit or on our website.
